Summarize a trademark watch report into actionable items
Use case
Use this prompt when a trademark watch service (CompuMark, Corsearch, Markify, or similar) sends the periodic report listing new third-party filings that may conflict with your portfolio. Watch reports are long, repetitive, and full of low-risk hits. This prompt turns the dump into a triaged memo with clear next actions for each mark.
The prompt
You are a trademark paralegal preparing a watch report summary for{{client_or_company}}'s in-house IP counsel. Your job is to triage the watch results and recommend actions. Inputs: - Reporting period:{{period}}- Watched marks (the client's portfolio entries being monitored):{{watched_marks}}- Watch results (raw report rows — applicant, mark, classes, jurisdictions, filing date, status):{{watch_results}}- Client's core goods and services:{{core_goods_services}}- Known competitive landscape or sensitive class areas:{{competitive_context}}- Budget and risk posture for oppositions:{{risk_posture}}Produce a memo with these sections: ## Executive Summary - Total hits this period and how many fall into each tier (High, Medium, Low, Noise) - The single most important development the client should know about ## Tier 1 — High Priority (recommend opposition, cease and desist, or further investigation) For each entry: - Third-party mark and applicant - Jurisdiction, classes, filing date, current status (and any opposition deadline) - Conflict analysis: similarity in sight, sound, and meaning; relatedness of goods and services; channels of trade - Recommended action with deadline (e.g., file opposition by DD Month YYYY, send cease and desist, request applicant file history) ## Tier 2 — Medium Priority (monitor and re-evaluate) Brief one-paragraph rationale per entry on why it does not yet warrant action but should be tracked. ## Tier 3 — Low Priority and Noise Numbered list with one-line dispositions. Do not waste space on these. ## Deadlines Calendar Table of every action item with its hard deadline and the responsible party. Tone: precise, conservative, and decision-oriented. Distinguish clearly between facts from the watch report and your conclusions. Flag anywhere you are inferring beyond the data.

NORTHWYND TRADING CO. — US App. 98/441,002 — applicant Northwynd Trading LLC — class 30 (coffee, tea) — filed March 12 2026 — published April 9 2026 — opposition window open 2. NORTHWND (stylized) — US App. 98/445,221 — class 30 (coffee pods) — filed March 19 2026 core_goods_services: roasted coffee beans, ground coffee, ready-to-drink coffee beverages, cafe and coffeehouse services competitive_context: aggressive new entrants in pod and ready-to-drink categories; EU expansion launching Q3 2026 risk_posture: willing to oppose direct class 30 conflicts; prefer cease and desist before opposition where viable
Output
## Executive Summary Six new third-party filings hit the watch this cycle. Two are Tier 1 (NORTHWYND TRADING CO. and NORTHWND for coffee pods), one is Tier 2 (NORTHWIND CAFE & ROASTERY EUTM, directly relevant to Q3 EU launch), and three are noise. The most important development is NORTHWND (US App. 98/445,221) for coffee pods. The mark is phonetically identical to NORTHWIND, the applicant is filing in our exact category, and our pod-format expansion is a stated 2026 priority. This is the strongest conflict in the cycle and should drive the immediate response. ## Tier 1 — High Priority **NORTHWYND TRADING CO. — US App. 98/441,002 (class 30, coffee and tea)** Applicant: Northwynd Trading LLC. Published April 9 2026. Opposition deadline May 9 2026 (extendable). Conflict analysis: NORTHWYND is visually and phonetically near-identical to NORTHWIND (single vowel substitution). Goods (coffee, tea) overlap directly with our class 30 registration. Channels of trade likely overlap (specialty grocery, online). Recommended action: File a 30-day extension of time to oppose by May 9 2026. In parallel, send a cease and desist offering coexistence terms (different geography or non-coffee categories). Escalate to opposition if no response by June 1 2026. **NORTHWND (stylized) — US App. 98/445,221 (class 30, coffee pods)** Applicant unknown from watch row; pull file history. Conflict analysis: NORTHWND is phonetically identical to NORTHWIND. Goods (coffee pods) are squarely within our class 30 footprint and a stated growth category. Stylization does not create distance. Recommended action: Order full file history and applicant identity within five business days. Prepare opposition draft. If applicant is a small operator, lead with cease and desist; if a strategic competitor, file opposition immediately upon publication. ## Tier 2 — Medium Priority **NORTHWIND CAFE & ROASTERY — EUTM App. 019,221,887 (classes 30 and 43)** Direct namesake mark in our exact classes, filed during examination. Because we are not yet registered in the EU, opposing is procedurally awkward. Action: accelerate the EUTM filing for NORTHWIND ROASTING CO. and prepare a Madrid Protocol designation. Re-evaluate at publication. ## Tier 3 — Low Priority and Noise 1. NORTH WINDS BREWERY (class 32, beer) — different goods, weak conflict, no action. 2. NORTHWIND BICYCLES (class 12) — unrelated goods, no action. 3. NORTHWIND CAPITAL (class 36, financial services) — unrelated goods, no action. ## Deadlines Calendar | Action | Mark | Deadline | Owner | | --- | --- | --- | --- | | File 30-day extension of time to oppose | NORTHWYND TRADING CO. | May 9 2026 | IP counsel | | Order file history and applicant ID | NORTHWND | May 2 2026 | Paralegal | | Send cease and desist | NORTHWYND TRADING CO. | May 16 2026 | IP counsel | | Decision: oppose or coexist | NORTHWYND TRADING CO. | June 1 2026 | IP counsel | | EUTM filing acceleration | NORTHWIND ROASTING CO. | May 31 2026 | Outside EU counsel |
Tips for best results
- 1Always pull the published date and opposition deadline before deciding tier — a strong conflict that has already cleared opposition is a different problem than one in the live window.
- 2Phonetic identity (NORTHWND, NORTHWYND) is often a stronger signal than visual similarity. Read the marks aloud.
- 3Tier 2 exists so you do not lose track of slow-burn conflicts. Re-run the watch summary against the prior period's Tier 2 list each cycle.
- 4Always order applicant identity before drafting cease and desist — sending one to a sophisticated competitor without preparation is a strategic mistake.
- 5This summary is paralegal triage, not a legal opinion. All opposition, cease and desist, and coexistence decisions require qualified trademark counsel review.
